Making rental bonds easier – Michael Wood

Transcripts: Kevin:  Queensland entrepreneur and lawyer Michael Wood launched an innovative new property-focused business late last year. We told you about it on the show. It aims to take some of the hassle out of renting. The company is called BondSure. It’s been progressing really well in the very short period of time since it’s been launched. Over 100 real estate officers around Australia have signed up, and according to Michael Wood, they’re adding quite a few each and every week. Michael joins us. Good morning, Michael. Michael:  Yes. Good morning, Kevin. Kevin:  What a great business this is. Firstly, tell us how it works. How does BondSure work? Michael:  Basically, rather than paying their bond up front, it offers renters the choice to pay that off in installments over 6 to 12 months, and then the money is deposited by us with the Residential Tenancy Authority. It’s all the same for the landlord there. But also what we’ve done is go a bit further. Not only the choice of installments rather than upfront cash, but we’ve introduced a new – rather revolutionary, I think – insurance product that protects that bond whilst it’s sitting there with the government. Of course, the landlord still has priority if there’s any rent default, but what we’re trying to do here is introduce a product that protects the bond against increased cost of cleaning and accidental damage, two issues that often erode the bond for the tenant at the end of the lease. Kevin:  Yes, we’ll talk in a moment about how many people don’t get their bond back or get absolutely get nothing at all back or even part of it. But just before we do that, why did you do this? Did you perceive there was a need for this to happen? Michael:  Yes. My main business is insurance, and my Lloyds broker in London introduced the concept of actually having a landlord waive the right to a bond and just have an insurance policy. It’s being done in a very small way over in America. The situation over in America with strata title is very different, so they approached me and said, “Look, Michael, could this work in Australia?” I looked into it, and I decided that given that we can have a couple of hundred different owners in one building – rather than like in America where often one person owns the whole building, all the units – what I thought was that rather than do away with the bond, let’s help the tenants and protect the landlord by still having that bond but then protecting it with an insurance policy. Kevin:  That’s interesting, Michael. Could it work in a single house situation where the owner would be happy with an insurance policy over a bond? Michael:  Most definitely. We offer it both for units and houses. The only difference there is another extra product that we have is a contents policy. There is a slight differential between units and houses, but otherwise, the pricing is all pretty much the same. Kevin:  I said in the intro that about a hundred offices around Australia have picked it up. What sort of reaction are you getting from them? Because I would have thought that this would be fairly popular with agents. Michael:  Yes. We’ve been really, really pleased by the support they’ve shown. The first thing is is the landlord still protected? Which of course, the landlord is. The money is sitting there with the RTA, and as I said, the landlord always has priority if there’s a rent default. But the big thing is there are often disputes, and I’m sure landlords agree that it’s a bit of a hassle at the end of a lease to be arguing with a tenant over what is damage and what isn’t. That’s one of the main reasons that not only did we introduce a product that is to protect against damage – such as damaged carpet, damaged curtains, damaged fittings – but also the increased cost of cleaning, because we didn’t want arguments about what is damage and what is cleaning. Yes, we’ve been very pleased, and also it helps them with their rollover of leases. We can be notified, and as an insurer, we pay it. It’s above a small excess, just to ensure that they do still do maintain the premises as they should. Kevin:  I’m keen to talk to you about how many people don’t actually get their bond back. I read with interest a New South Wales story, of course, that based on the Rental Bond Annual Report there, they suggested that 35% of tenants received some of their bond back, while one in ten received absolutely nothing. Michael:  It’s anywhere between 35 and 50%, but generally in the 40%s. Kevin:  It’s a great product. If you want to know a little bit more about it, BondSure is the name. X By Javid Hussain and Jibran Ahmad | PARACHINAR, Pakistan An explosion apparently targeting a mosque in Pakistan's northwestern city of Parachinar, in a remote area bordering Afghanistan, killed at least 22 people on Friday and wounded dozens, officials said. There was no immediate claim of responsibility but the blast, which took place as people gathered for Friday prayers near the women's entrance of a Shia mosque in the central bazaar, follows a series of attacks this year. The local political agent, Ikramullah Khan, said the death toll had reached 22, with 70 injured. A parliamentarian from Parachinar, Sajid Hussain, said gunfire preceded the blast, which he described as a suicide attack. "The attack took place in a busy area and a women's mosque appears to be the target," he said. ADVERTISING Last month, more than 80 people were killed and dozens wounded in an attack on a crowded Sufi shrine in southern Pakistan that was claimed by Islamic State. In January, at least 21 people were killed when an explosion hit a vegetable market in Parachinar, capital of the Kurram tribal region, where Pakistani security forces have battled militant groups for years. Authorities in mainly Sunni-Muslim Pakistan said a military rescue helicopter had been sent to the scene to help evacuate the injured. Mumtaz Hussain, a doctor at the Agency Headquarters Hospital in the region, said five bodies, including a woman and two children, and more than three dozen wounded had been brought to the hospital and an appeal for blood donors had been made. "Patients are being brought to us in private cars and ambulances and we have received over three dozen patients so far," Hussain told Reuters. The attacks have shattered hopes that Pakistan may have come through the militant violence that has scarred its recent history and increased pressure on Prime Minister Nawaz Sharif's government to show it was improving security. Sharif condemned the attack and said the government would keep up efforts to "eliminate the menace of terrorism". In a statement, he said: "The network of terrorists has already been broken and it is our national duty to continue this war until the complete annihilation of the scourge of terrorism from our soil." Toshiba offered $17.9 billion for chip unit by Silver Lake and Broadcom: Nikkei

Reuters/Issei Kato Toshiba offered $17.9 billion for chip unit by U.S. private equity firm Silver Lake Partners LP [SILAK.UL] and U.S. chipmaker Broadcom Ltd have offered Toshiba Corp about 2 trillion yen ($17.9 billion) for its chip unit, the Nikkei business daily reported on Friday. About 10 potential bidders are interested in buying a stake in the NAN flash memory maker, a source with knowledge of the planned sale told Reuters earlier. inRead invented by Teads Suitors include Western Digital Corp which operates a chip plant with Toshiba in Japan, Micron Technology Inc, South Korean chipmaker SK Hynix Inc and financial investors. Toshiba wants to make at least 1 trillion yen from the sale of part or all of the business to cover writedowns at its Westinghouse nuclear unit. It says it expects investors to value its chip operations at about 2 trillion yen. Toshiba is also asking potential bidders whether they intend to resell their stakes and wants to make a decision on the sale before a shareholders meeting in June, the Nikkei said, without saying where it obtained the information. Natural disaster consequences can be unpredictable. When Debbie, a category four system, slammed into the Queensland coast 11 days ago, remarkably there were no fatalities in its immediate aftermath and few serious injuries were reported. Through flying debris unleashed by violent winds that wrecked homes and businesses, communities around the Whitsunday holiday region felt the full force of what was labelled a "monster" cyclone. At its worst, gusts were recorded at 263km/h (163 mph). But residents and tourists had been told what was coming. Crucially, the slow-moving storm had given authorities time to trigger emergency plans and issue repeated warnings. Thousands of people heeded advice to leave, while others hunkered down and waited. "There is a degree of luck about these big cyclones," explained Richard Thornton, head of the Bushfire and Natural Hazards Cooperative Research Centre (BNHCRC). If the cyclone had gone into Townsville or [made] a direct hit on to Cairns, we would see much bigger damage and much bigger loss of life." Each year, Australia experiences natural disasters including storms, bushfires, floods, landslides and minor earthquakes. Tropical Australia typically experiences about five cyclones, usually between November and April. Although an accepted part of life in the nation's north, cyclones can be brutal and surprise communities. Records show about 66 people were killed, while iconic images captured a city in ruins. At least 90% of homes in the Northern Territory capital were destroyed or badly damaged. Of course, many lessons were learnt. Houses built in storm-prone areas of the Northern Territory since 1975 should be designed to withstand a category four cyclone. In February 2009, the Black Saturday disaster killed 173 people near Melbourne, highlighting Australia's terrible relationship with fire. A royal commission, the country's highest form of inquiry, would later recommend sweeping changes to the way officials prepared for and responded to emergencies. Despite the ongoing threat of bushfires, BNHCRC research has shown that many Australians either don't properly prepare, or have an emergency plan that is "pretty flaky at times", according to Mr Thornton. "We know we will have another cyclone like Debbie or we'll have another day as bad as Black Saturday, so what do we need to do to prepare for those inevitable events?" he said. Media caption Officials have warned against playing in floodwaters "The majority of people who die in floods drive into flooded streams and rivers, so we have got to change some of that risk-taking behaviour," Mr Thornton said. Only a day after Cyclone Debbie made landfall, Queensland's Fire and Emergency Services Commissioner, Katarina Carroll, said her "biggest concern" was people getting trapped in floodwaters. A week later, floods had claimed at least six lives as the storm lashed a 1,200km (745 miles) stretch of coast down to northern New South Wales. Learning from history Preparation and information invariably save lives when fires rage, levees burst banks or a storm advances. The Australian Institute for Disaster Resilience recently launched a new "knowledge hub" to help Australians prepare for the worst. "Complacency is a killer," said John Bates, the institute's director. "The challenge with major natural hazards and disasters is that people remember them in the immediate aftermath of an event and as time goes on they tend to forget sometimes what it was like." He said people should not rely on government agencies and emergency response organisations to look after them all the time. "Underestimating the force of nature is the biggest mistake most people make," he explained. "People make decisions based on their emotions, not on their knowledge. People will attempt to do deep-water crossings in fast-flowing water [having] never done it before, and have got no idea what they are doing and turn a mishap into a tragedy." Reverend Dr Stephen Robinson, the Uniting Church's national disaster recovery officer, is one person helping those left feeling vulnerable. "One of the most important things is to be able to help to calm people very early on in the process," he said. "With climate change we are seeing increased ferocity and frequency of these sorts of events. That is not going to go away. Where people are affected multiple times they you get this more endemic psychological stresses that don't recover."

Trump signs order dismantling Obama-era climate policies

Tue Mar 28, 2017 | 5:59 PM EDT By Valerie Volcovici and Jeff Mason | WASHINGTON President Donald Trump on Tuesday signed an order to undo Obama-era climate change regulations, keeping a campaign promise to support the coal industry and calling into question U.S. support for an international deal to fight global warming. Flanked by coal miners and coal company executives, Trump proclaimed his "Energy Independence" executive order at the headquarters of the Environmental Protection Agency. The move drew swift backlash from a coalition of 23 states and local governments, as well as environmental groups, which called the decree a threat to public health and vowed to fight it in court. The order's main target is former President Barack Obama's Clean Power Plan, which required states to slash carbon emissions from power plants - a key factor in the United States' ability to meet its commitments under a climate change accord reached by nearly 200 countries in Paris in 2015. Trump's decree also reverses a ban on coal leasing on federal lands, undoes rules to curb methane emissions from oil and gas production and reduces the weight of climate change and carbon emissions in policy and infrastructure permitting decisions. Carbon dioxide and methane are two of the main greenhouse gases blamed by scientists for heating the earth. "I am taking historic steps to lift restrictions on American energy, to reverse government intrusion and to cancel job-killing regulations," Trump said at the EPA. The room was filled with miners, coal company executives and staff from industry groups, who applauded loudly as Trump spoke. Shares in U.S. coal companies edged higher in response. The wide-ranging order is the boldest yet in Trump’s broader push to cut environmental regulation to revive the drilling and mining industries, a promise he made repeatedly during the 2016 presidential campaign. Energy analysts and executives have questioned whether the moves will have a big effect on their industries, and environmentalists have called them reckless. ADVERTISEMENT "I cannot tell you how many jobs the executive order is going to create, but I can tell you that it provides confidence in this administration’s commitment to the coal industry," Kentucky Coal Association president Tyler White told Reuters. Environmental groups heaped scorn on Trump's order, arguing it was dangerous and went against the broader global trend toward cleaner energy technologies. A coalition of mostly Democrat-led states and local governments issued a statement saying they would oppose the order in court. "We won’t hesitate to protect those we serve — including by aggressively opposing in court President Trump’s actions that ignore both the law and the critical importance of confronting the very real threat of climate change," the coalition, led by New York Attorney General Eric Schneiderman, said in a statement. The coalition includes states such as California, Massachusetts and Virginia, as well as cities including Chicago, Philadelphia and Boulder, Colorado. PARIS DEAL NOT ADDRESSED U.S. presidents have aimed to reduce U.S. dependence on foreign oil since the Arab oil embargo of the 1970s, which triggered soaring prices. But the United States still imports about 7.9 million barrels of crude oil a day, almost enough to meet total oil demand in Japan and India combined. An overwhelming majority of scientists believe that human use of oil and coal for energy is a main driver of climate change, causing a damaging rise in sea levels, droughts and more frequent violent storms. But Trump and several members of his administration have doubts about climate change, and Trump promised during his campaign to pull the United States out of the Paris climate accord, arguing it would hurt U.S. business. Since being elected, Trump has been mum on the Paris deal and the executive order does not address it. "Trying to make fossil fuels remain competitive in the face of a booming clean renewable power sector, with the clean air and plentiful jobs it continues to generate, is going against the flow of economics," she said. The order directs the EPA to start a formal process to undo the Clean Power Plan, which was introduced by Obama in 2014 but was never implemented in part because of legal challenges brought by Republican-controlled states. The Clean Power Plan required states to collectively cut carbon emissions from power plants by 32 percent below 2005 levels by 2030. Some 85 percent of U.S. states are on track to meet the targets despite the fact the rule has not been implemented, according to Bill Becker, director of the National Association of Clean Air Agencies, a group of state and local air pollution control agencies. Trump’s order also lifts the Interior Department's Bureau of Land Management temporary ban on coal leasing on federal property put in place by Obama in 2016 as part of a review to study the program's impact on climate change and ensure royalty revenues were fair to taxpayers. It also asks federal agencies to discount the cost of carbon in policy decisions and the weight of climate change considerations in infrastructure permitting, and it reverses rules limiting methane leakage from oil and gas facilities. I have broken it in not one but in four different ways, one of which involved barefaced lying. The normal thing would be to keep quiet about this, but I am choosing to shop myself, partly because I have reason to believe I am in good company but also because the real wrongdoing was not done by me, but by the codes themselves – which breach the principles of common sense, human motivation, and snappy writing. Codes of conduct are scary things. Charlotte Hogg, who helped write the Bank of England's code and who is also an adviser to my charity, still managed to get tripped up by it (by not disclosing that her brother worked for Barclays) and this month had to resign as deputy governor. Seeing what happened to her, I decided to do something I had never done before: settle down to read my own. The first thing The Financial Times' corporate code of conduct demands is that employees "act in a professional, honest and ethical manner" – which is fine, if a little general. But by the second bullet point I had already come a cropper: "Be familiar with the information contained in this code," it orders. In my defence I have tried to read it on various occasions in past years but I am a slow reader and nine pages of dull text is a bit much. I don't read the small print This does not make me an outlier. It makes me just like most humans, who are not naturally drawn to the small print on health and safety policies. In the past week I have asked everyone I have met if they have read their employers' codes of conduct. The majority either said no or looked sheepish and said they had skimmed it. Some claimed to have read theirs, but when asked what it contained could do no better than: "Oh you know, the usual stuff." This means every year, millions of wage slaves – including me – commit another violation and perjure themselves by ticking a box claiming to have read, understood and committed to complying with the code, when they have done nothing of the sort. The next breach concerns my obligation to report any colleague who is not following the code. I know for a fact that a certain FT journalist has not read it properly either, in which case I am again at fault for not shopping him. But to grass up a person for something so tiny would interfere with my own ethical principle of not sneaking on a friend, especially one who is a fine, upstanding journalist. So what should I do? On this, as on every tricky, real-life dilemma, a code of conduct is of no help at all. The Private Eye Code As for the rest of the code, it is perfectly sensible in a general sort of way. Alas I fear the state of my desk may not be 100 per cent compliant with fire regulations, and I see I have an obligation "to read, understand and abide by our Treasury Policy, Travel and Expenses Policy and Data Retention and Destruction Policy" – which saps the spirits no end. Yet by comparison to most other codes, the FT's is a work of brevity and precision. At my alma mater, JPMorgan, the new code runs to 50 pages, beginning with a picture of Jamie Dimon smiling angelically and staring into the middle distance. There are further pictures of happy women and black people, as well as one of employees throwing buckets of water over each others' heads. How the latter relates to the commandment that all JPMorgan staff treat each other with dignity, it does not say. The report is an interminable mish-mash of important things and trivial ones – of strict regulations on money laundering and vague waffle about being a good global citizen. Which is nonsensical in a code of conduct. What does it mean? And what business is it of the bank's? I would rather a code that came without the pictures, the values and the cloying letter from the chief executive, but with a simple list of clear commandments. A reasonable start might be: Don't do anything illegal. Don't do anything that fails the Private Eye test – would it look ugly if published in the satirical magazine? Don't do anything that you would be ashamed to tell your colleagues about. The trouble with this is that it misses what a code of conduct is really for – part PR exercise, part excuse for firing anyone who a manager deems to have violated it. Sometimes, as the Bank of England has found out, the trap catches the wrong person. Marriage or relationship breakdown rollover of capital gains tax

Any changes to ownership of assets on or after 20 September 1985, is subject to capital gains tax (CGT). An exception to this rule is the automatic rollover that might be applicable in certain cases where an asset is transferred to a spouse as a result of the end of your marriage or relationship.

The spouse who receives the asset (the transferee spouse) will realize the capital gain or loss, when they dispose of the asset at a later stage. The cost base of such an asset is thus transferred to the transferee spouse.

The transferor spouse will therefore not take the possible capital gain or loss into account. The cost base of the asset is transferred to the transferee spouse.

This rollover applies automatically if your marriage ended on or after 20 September 1985, and:

• You transfer an asset (or a share of an asset) to your spouse
• You receive an asset (or a share of an asset) from your spouse
• A company or trustee of a trust transfers an asset to you or your spouse

Neither party can choose whether this applies or not.

Definitions

 Asset includes a share of, or an interest in, a jointly owned asset.

Spouse includes your former spouse.

Transfer of an asset means transferring ownership of an asset to the transferee spouse. This includes “creating” an asset for their benefit (the right to use property would be an example)

Transferee spouse refers to the spouse who receives the asset.

Transferor spouse refers to the spouse (or a company or the trustee of a trust) who transfers the asset to the transferee spouse.

Conditions for the marriage or relationship breakdown rollover

This automatic rollover of capital gains tax will apply, if the CGT event happened as a result of:

• A court order
• A court order made by consent under the Family Law Act 1975
• A court order made under a similar law of a foreign country
• A court order under a state, territory or foreign law relating to the breakdown of the relationship between spouses

A CGT event that occurred after 12 December 2006, is also subject to the rollover, if the event happened because of one of the following:

• A binding financial agreement under section 90G of the Family Law Act 1975, or a corresponding written agreement that is binding because of a corresponding foreign law.
• An arbitral award made after a process of arbitration in terms of Section 13H of the Family Law Act 1975, or a similar award under a corresponding state, territory or foreign law.
• A written agreement that is binding (because of an applicable state, territory or foreign law), and a court is prevented from making an order relating to matters to which the agreement applies, or to make an order that is inconsistent with the terms of such agreement, regarding those matters, unless the agreement is set aside or changed. The following agreements qualify as ‘binding agreements’:
• A domestic relationship agreement or termination agreement that complies with subsection 47(1) of the New South Wales Property (Relationships) Act 1984, or with subsection 33(1) of the Australian Capital Territory’s Domestic Relationships Act 1994
• A recognised agreement in terms of the Queensland Property Law Act 1974
• A cohabitation agreement that is a certified agreement within the meaning of the South Australian’s Domestic Partner Property Act 1996, or a cohabitation agreement or separation agreement that complies with subsection 45(2) of the Northern Territory’s De Facto Relationships Act
• A personal relationship agreement or separation agreement that complies with subsection 62(1) of the Tasmanian Relationships Act 2003.
• A financial agreement in terms of subsection 205ZS(1) of the Western Australian Family Court Act 1997
• A relationship agreement that complies with subsections 59(1) and (2) of the Victorian Relationships Act 2008 (which came into effect on 1 December 2008).

The rollover also applies (since 1 March 2009) to CGT events that resulted from binding financial agreements between de facto couples, or corresponding written agreements that are binding in terms of foreign laws. See section 90UJ of the Family Law 1975. The marriage or relationship breakdown rollover is also applicable to same sex couples since 1 July 2009.

Capital Gains Tax events that apply to marriage or relationship breakdown rollover

The rollover of CGT will apply when assets are transferred as a result of a court order, agreement or award. It is referred to as CGT events. For the rollover to apply, one of the following events must occur. The transferor:

• Transfers ownership of the asset to the transferee spouse, or
• Concludes an agreement which transfers the right to use and enjoy the asset to the transferee spouse, and ownership of the asset will, or may, transfer to the transferee spouse at the end of the agreement.

Important: Rollover will not happen if ownership of the asset does not pass to the transferee spouse at the end of the agreement.

• Creates a contractual, or other, right in favour of the transferee spouse, or
• Grants an option to the transferee spouse, or renews or extends, an option granted previously to them , or
• Grants the transferee spouse a right to receive income from activities relating to a prospecting or mining entitlement (or an interest in one), owned by the transferor spouse, or
• Is a lessor and grants, renews or extends a lease to the transferee spouse.

There is no rollover for the transfer of trading stock.

Timing of the CGT event

It is important to establish when the CGT events occur. Certain changes to the rollover rules only apply after a certain date.

Establishing timing:

• When an asset is transferred under contract, the CGT event happens upon entering into the contract. The time at which the contract takes effect depends on the terms and conditions set out in the contract, and whether it meets all the requirements set out in the applicable legislation.
• A binding financial agreement may be a contract. For a binding financial agreement to take effect, a separation declaration in terms of section 90DA of the Family Law Act 1975, must be made before the agreement can take effect.
• A binding agreement used by a marriage and relationship breakdown couple may also be a contract.

In the absence of a contract, the CGT event occurs when the change of ownership occurs.

When assets are transferred under court order, or arbitral award, the CGT event will only take place when the asset is transferred under such order or award. It is not a contractual transfer.

Take note: If an asset is transferred in terms of an agreement referred to as a CGT Event B1, the event happens when use of the asset transfers to the transferee spouse.

Separating couples can avoid costly and drawn out court processes, by entering into binding financial agreements, or settling financial and property matters by using arbitration.

Agreements that do not require court intervention

If the transfer of assets occur as a result of a binding financial agreement or a binding agreement used by separating couples, rollover will only apply if at the time of the transfer:

• The spouses are separated
• There is no reasonable possibility of a reconciliation
• The transfer occurred due to reasons directly connected to the breakdown of the marriage or relationship.

If, for example, the couple agreed before the breakdown that the particular property was to be transferred from one spouse to the other, for reasons not related to the breakdown, the rollover will not apply. It was not directly connected to the breakdown. The rollover will also not apply if the agreement deals with the transfer of non-specific property, the property is not transferred for a considerable time after the agreement and circumstances suggest that the transfer was not directly connected to the breakdown.

Consequences of rollover applying

If YOU transfer the asset, rollover means:

• You ignore any capital gain or loss for assets acquired before 20 September 1985
• If the asset was acquired on or after 20 September 1985, the rollover ensures that you ignore any capital gains or loss made from the CGT event that involves you and the transferee spouse.
• If the asset is transferred TO YOU, again you need to consider the date the asset was acquired by the transferor:

Assets acquired before 20 September 1985

If the transferor acquired the CGT asset before this date, and it was transferred to you as a result of the breakdown of your marriage or relationship, you are also deemed to have acquired the asset before 20 September 1985. Asset includes a share of a jointly owned asset.          

Take note – if you make a major capital improvement to that asset after 20 September 1985, or if another CGT event occurs to that asset, you may be liable for CGT when you dispose of that asset.

Assets acquired on or after 20 September 1985

If you receive the CGT asset (or a share of a jointly owned asset) and a marriage or relationship rollover applies, you are deemed to have acquired the asset at the time it was transferred to you.

Consequences of rollover not applying

Marriage or relationship breakdown rollover does not apply when you and your spouse divide the assets by way of a private or informal agreement. In such a case any capital gain or loss resulting from the transfer of the asset must be taken into account when completing your tax return for that year. The spouse to whom the asset is transferred is deemed to have acquired the asset at the time of the transfer.

Take note: Special rules may apply if the spouse receiving the property does not pay anything, or if the amount paid is not the market value of the property. In such cases the transferee is deemed to have paid the market value and the transferor is deemed to have received the market value of the property, if the parties were not dealing with each other at arm’s length.

You are only deemed to have dealt with each other at arm’s length, if both act independently, and neither exercises influence or control over the other spouse in connection with the transaction. To determine whether parties dealt at arm’s length, the nature of their relationship will be considered, as well as the quality of the bargaining between them.

Calculating your capital gain or loss

CGT only applies to assets acquired on or after 20 September 1985.

In order to determine whether there has been a capital gain or loss, you must determine the cost base and the proceeds. On disposal, if the proceeds are less than the reduced cost base, the difference is a capital loss. If the proceeds are more than the cost base, it is a capital gain.

The cost base (and reduced cost base) at the time of the transfer of the asset for you and your spouse will be the same. Any costs, such as conveyance cost and stamp duties, incurred by you or your spouse (the previous owner) in transferring the asset on the breakdown of marriage relationship, will be taken into account to determine the cost base.

Timing is important.

If you acquired the asset from your spouse before 11:45 on 21 September 1999, the value of a gain or loss can be indexed. Indexation only applies if you and your spouse owned the asset for more than 1 year. The cost is then calculated based on the consumer price index (CPI), taking into account the changing value of the dollar.

If you acquire the asset after 11:45 on 21 September 1999, you cannot use the indexation method. If you and your spouse owned the asset for more than 1 year, you can use the discount method to receive a 50% discount on the capital gain for individual taxpayers.

If the assets were acquired between 20 September 1985 and 20 September 1999, you have an option of using indexation (up to the CPI as at 30 September 1999) or using the discount method.

Calculating Capital Gains Tax or GTC can be a very complex process. You may need to consult a lawyer or a tax specialist.

Treatment of certain assets

Collectables and personal use items

Collectables, like works of art, and assets for personal use remain such assets when they are transferred from one spouse to another in a marriage or relationship breakdown rollover.

Cash settlements

If the spouses were separated and there was no reasonable possibility of them resuming cohabitation, no CGT liability will arise at the ending of the spouses’ rights, which gave rise to the payment of a cash settlement.

Real estate that was the main residence

• CGT event occurred on or before 12 December 2006

You are entitled to a CGT exemption when you dispose of a dwelling that was your main residence, after it was transferred to you. The exemption applies if your spouse acquired the property on or after 20 September 1985 and it was transferred to you as a result of a CGT event that occurred on or before 12 December 2006, and the marriage or relationship breakdown rollover applies. You will be exempt from CGT for the period that the dwelling was your main residence after the transfer.

You may only qualify for a partial exemption if:

• It was your main residence for only a part of the period, after transfer.
• You derived assessable income from its use
• The land on which the dwelling is situated is more than two hectares.

It is important to keep proper records of transactions relating to the dwelling.

If you don’t have it, request records from your spouse stating how and when the property (or an interest in it) was acquired and a record of the cost base when it was transferred to you.

• CGT event occurred after 12 December 2006

If the transfer to you occurred as a result of a CGT event that happened after 12 December 2006, and the marriage or relationship breakdown rollover applies, the way in which both of you used the dwelling during the time of your combined ownership, will be taken into account, when deciding whether you qualify for the main residence exemption.

You will qualify for a full exemption from CGT if:

• The dwelling was used as your main residence for the full period that your spouse owned the dwelling, and it was not used to produce assessable income.
• You used the dwelling as your main residence for the period you owned it and did not use the dwelling to produce assessable income.

The land on which the dwelling is situated must be less than two hectares to be exempt from CGT when you dispose of the dwelling.

If the above conditions relating to use of the dwelling are not met, you may still qualify for a partial exemption. You can use a set formula to work out the taxable portion of the capital gain. Records (or request copies from your spouse) indicating the following must be kept:

• When and how the dwelling was acquired,
• The cost base when transferred to you,
• The periods it was used to produce assessable income, and the portion of the dwelling that was used to produce such income, and
• The period it was used as the main residence.

“Home first used to produce income” rule

“The home first used to produce income” rule may apply if a dwelling was first used as a main residence from its acquisition and then is later used to produce income. It will only apply if the first income producing use was after 20 August 1996 and the dwelling qualifies for full main residence exemption immediately prior to such use.

The way you and your spouse used the dwelling during the period of combined ownership will be taken into account when applying the CGT main residence exemption, if the dwelling is transferred to you under a CGT event that occurred 

after 12 December 2006, and where the marriage and relationship rollover applies to the transfer.

To determine the market value of the dwelling, you are deemed to have acquired the dwelling at the time it is first used to produce income.

• Choices made under the CGT main residence rules

In certain circumstances, where the rollover does not apply, you may choose to treat a dwelling as your main residence for a specific period, even if you are yet to live in it, or you no longer live in it.

If, for example, the transferor spouse and the transferee spouse had different main residences before they separated, they need to choose to regard one of the dwellings as the main residence for both of them for the period, or, choose the different dwellings as their main residences and obtain partial exemption on both.

The way the person completes his or hers tax return for the income year, is usually a sufficient indication of the choice made. The choice whether to apply for the full or partial exemption, should be made by the day the person lodges their tax return.

A statement signed by the transferor spouse, and given to the transferee spouse at the time of the property settlement, serves as evidence of the choice made. The transferee spouse can use that statement as evidence to support the calculation of capital gain or loss at a later stage when they dispose of the dwelling.

Once a choice is made, it is binding and cannot be changed. Note that the ATO has the authority to allow further time for a choice to be made (after the time it is required to be made under the law), in appropriate cases. But once the choice is made, it is final.

Dwellings transferred from a company or the trustee of a trust after marriage or relationship breakdown

You cannot get the main residence exemption for any period that the dwelling was owned by a company or a trustee – even if you lived in the dwelling during that time. You are treated as if you owned the dwelling for the period the company or trustee owned it. If the dwelling is transferred to you from the company or trustee of a trust, and the marriage and relationship breakdown rollover applies, you will only qualify for the exemption for the period after transfer, when you used it as your main residence.

Note: Dwelling includes an interest in a dwelling.

Rights that are created

In certain instances, you will acquire certain assets, or rights, where your spouse may “create” such rights in your favour. For the purposes of CGT, you will be deemed to have acquired such a right or asset at the time stipulated by the CGT event. Examples of such rights are:

• Contractual rights
• An option
• A right to income from mining
• Granting a lease

If the event creating the asset is a contract, the right (asset) will be acquired upon entering the contract. If there is no contract, the time you acquired the asset will be the time the right is created.

Superannuation interests

There are provisions in place to allow spouses in a small super fund to separate their super arrangements on the breakdown of the marriage or relationship without incurring any CGT liability.

Payment splits

The CGT rollover may apply if a payment split applies to an interest in a small superannuation fund, on the breakdown of a relationship between spouses, and a CGT asset is transferred from one small superannuation fund to another complying fund.

Transfer of own interest in a small superannuation fund

If both spouses hold an interest in the same small superannuation fund before the transfer, the trustee may qualify for CGT rollover when the trustee transfers an asset representing the entire personal interest of one of the spouses (or former spouses) to the trustee of another complying superannuation fund. The transfer must be for the benefit of that spouse.

A small superannuation fund is one that is a complying fund and has fewer than five members.

Assets transferred by a company

When a company or a trustee of a trust transfers a CGT asset to a spouse, the relevant cost base (or reduced cost base) must be adjusted to reflect a reduction in market value, as a result of the transfer of the CGT asset. Interests in the company may be shares in the company, or indirect interests in the shares. It may be units in a unit trust and other interests in the trust.

Note: If the transferee spouse is a shareholder or an associate of a shareholder, the transfer of the asset from the company may amount to a dividend payment.

There are special rules for calculating capital gain or capital loss when the CGT event relates to situations where the transferor is a controlled foreign corporation or foreign trust.

Summary

Transferring of assets after a marriage or relationship breakdown can be a complex issue. When assets are transferred between spouses under a court-approved arrangement, certain rollover provisions automatically apply. Transfers made under private arrangements are not subject to rollover. The normal CGT rules apply. Calculating Capital Gains Tax can be a very complex process. You may need to consult a lawyer or a tax specialist.

X By Costas Pitas and Estelle Shirbon | LONDON Police arrested seven people in the investigation into a lone-wolf attacker who killed three people and injured 40 before being shot dead by police near parliament in London, Britain's most senior counter-terrorism officer said on Thursday. Mark Rowley said there were four dead including the attacker and 29 people still being treated in hospital, seven of whom were in a critical condition. Police had said on Wednesday that the death toll was five in the worst such attack in Britain since 2005. The attacker sped across Westminster Bridge in a car, mowing down pedestrians along the way, then ran through the gates of the nearby parliament building and stabbed a policeman before being shot dead. Authorities have said they are working on the assumption that the attack was Islamist-related. Britons have been shocked by the fact that the attacker was able to cause such mayhem in the heart of the capital equipped with nothing more sophisticated than a hired car and a knife. "The police and agencies that we rely on for our security have forestalled a large number of these attacks in recent years, over a dozen last year," said defense minister Michael Fallon. "This kind of attack, this lone-wolf attack, using things from daily life, a vehicle, a knife, are much more difficult to forestall," he told the BBC. Police believe they know the identity of the attacker but have not named him. ADVERTISEMENT "We're dealing with an enemy, a terrorist enemy, that is not making demands or taking people hostage, but simply wants to kill as many people as possible. This is a new element to international terrorism," Fallon said. Rowley said police had searched six addresses in London, Birmingham and other parts of the country in their investigation. "It is still our belief ... that this attacker acted alone and was inspired by international terrorism. At this stage we have no specific information about further threats to the public," Rowley said. He said there was a mix of nationalities among the dead but gave no details. The victims were the policeman, Keith Palmer, who was stabbed and two members of the public, a woman in her mid-40s and a man in his mid-50s. The fourth dead was the assailant. French Foreign Minister Jean-Marc Ayrault was expected to arrive in London to visit them at hospital, French media reported. There were also five South Koreans among the injured, South Korea's foreign ministry said in Seoul. A minute of silence to honor the victims will be held at 0933 GMT in parliament, outside police headquarters at New Scotland Yard, and in the Scottish parliament in Edinburgh. Prime Minister Theresa May was due to make a statement to parliament on the attack at 1030 GMT. Fallon said security arrangements at parliament would be reviewed. Westminster Bridge remained cordoned off with a strong police presence. The nearby Westminster underground rail station, normally a busy hub in the morning rush hour, was not accessible from the street as it was within the cordon. May said on Wednesday the location of the attack was not an accident. She said any assault on British values of liberty, democracy and freedom of speech was doomed to failure and Britons would not be divided by such acts. But anti-immigration groups were quick to make links between immigration and the attack. Leave.EU, a group that has campaigned for immigration to be severely restrained as part of Britain's exit from the European Union, accused mainstream politicians of facilitating acts of terror by failing to secure borders. "We are sick, tired but perhaps even more so we are angry that recent governments across Europe have enabled these attacks through grossly negligible policies that have left us vulnerable," the group said in a statement. In France, far-right presidential candidate Marine Le Pen also drew a link, saying that events in London highlighted the importance of protecting national borders and stepping up security measures. The three were students aged around 15 or 16 of the Concarneau Lycee in Brittany, western France, according to a report in Le Telegramme regional newspaper. Prime Minister Bernard Cazeneuve confirmed on Twitter that the three were schoolchildren. The report in Le Telegramme cited a fellow students who was at the scene of what British police have described as a terrorist incident, saying the three were hit by a car that was involved whilst walking on Westminister Bridge.
