September 12, 2012 - 11:15:43 pm First, Payment Article 580 The check shall be payable at sight, and every statement contrary to that shall be considered as if it was not. If the check was submitted before the day mentioned in it as the date of the issuance, it shall be paid on the day of submission. Article 580 (amended by Law 7 2010, Article 1) to “The check shall be payable at sight, and every statement contrary to that shall be considered as if it was not. If the later date was mentioned in the check for the real withdrawal date and it was submitted for the payment before the date, the bank has to refrain from the payment of its value until the day described in it as the date of its issuance. If the bank made the payment before that date, it shall be responsible for damages arising out of this payment”. Article 581 The check drawn in Qatar and the same is payable in it shall be submitted for the payment within six months at most, and if was drawn out of Qatar and the same is payable in it, shall be submitted within eight months at most. The above-mentioned shall start from the date mentioned on the check as it is date of of issue. The submission of the check to one of the banks or reserve its amount by telephone or telegram by this bank with the drawee bank as well as the submission of the check to one of the clearing houses or other party that is legally recognised shall be considered as its submission for the payment. Article 582 If the check was drawn between the two countries of different calendar, its date of issue shall be referred to the corresponding day in the calender of the country of payment. Article 583 If the check is payable in Qatar, the drawee bank cannot refrain from paying it, if it has the balance for the payment, even if the deadline of submission elapsed. The objection by the drawer shall not be accepted in paying the check, except in the case of its loss or bankruptcy of the holder or his detention. If the drawer opposed for other reasons not mentioned in the preceding paragraph and the bank declined to make the payment, the court shall, upon the appeal of the holder, order to reject the objection, even if the claim is genuine. Article 584 If the drawer died or lost the eligibility or went bankrupt after the check is issued, this shall not affect the provisions thereof. Article 585 If the balance for the payment is less than the amount of the check the bearer can request from the drawee to pay the partial amount as much as he has, and ask him to mark this payment on the back of the check. The bank has to give him a certificate and prove the right of recourse for the rest with this certificate or the protest.
